1. Our services
We provide local search marketing services. Depending on your plan, these may include Google Business Profile setup and management, review request systems, directory listings, website pages and monthly reporting.
What's included in your plan is set out on our pricing page or in your proposal.
2. No guaranteed rankings
Google decides search rankings and changes how it ranks businesses without notice. We don't guarantee any particular position, number of calls or amount of revenue.
We do commit to delivering the work in your plan. Our Guarantee page explains exactly what we promise and what happens if we fall short.
3. Term and cancellation
Monthly plans start with a 90-day foundation period to rank in the top 3 on Google. After that, they continue month to month until either of us cancels.
If you cancel during the foundation period, no further payments are required.
One-off services end when the work is delivered.
We may end the agreement with 30 days' notice, or straight away if an invoice is more than 30 days overdue or you ask us to do something that breaks Google's guidelines or the law.
4. Fees and payment
- Fees are in Australian dollars and exclude GST unless stated.
- Monthly fees are invoiced in advance and due within 7 days.
- One-off setup fees are invoiced before work starts.
- We may change our fees with 30 days' written notice. If you don't accept a change, you can cancel before it takes effect.
5. What we need from you
- Manager access to your Google Business Profile, website and any other accounts we need to do the work.
- Accurate information about your business, services, locations and licences.
- Reasonably prompt replies when we need a decision or approval.
You're responsible for the accuracy of the information you give us, and for holding any licences needed to offer the services you advertise.
6. Following the rules
We follow Google's guidelines and the Australian Consumer Law. We won't write fake reviews, offer incentives for reviews, add keywords to your business name, or use an address you're not entitled to use. If asked to, we'll decline.
7. Ownership
Your Google Business Profile, website, domain and accounts belong to you. You can remove our access at any time.
Content we create for you, such as page copy, posts and photos we take, becomes yours once the related invoice is paid. We keep ownership of our own templates, tools and methods.
8. Suspensions and third-party platforms
Google, Apple, Bing and directory sites can change, suspend or remove listings at their own discretion. We're not responsible for their decisions. If you're on a monthly plan and your profile is suspended, we'll handle the reinstatement request at no extra charge.
9. Confidentiality and privacy
We keep your login details and business information confidential, and handle personal information as set out in our Privacy Policy.
10. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that can't lawfully be excluded.
Where the law allows, if our services fail a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
To the extent permitted by law, we're not liable for indirect or consequential loss, including loss of profit or revenue, and our total liability is limited to the fees you paid us in the three months before the claim.
11. Changes to these terms
We may update these terms. We'll email clients about any material change at least 30 days before it applies to them.
12. Governing law
These terms are governed by the laws of New South Wales, Australia.
